Med Spa Compliance That Holds Up Every Day

OPERATIONAL COMPLIANCE, ALONGSIDE YOUR ATTORNEY

MED SPA COMPLIANCE

Your attorney determines what the rules require. Your medical director owns clinical oversight. Luminary helps you build a practice that meets those requirements every day and prices them into every business decision.

This page is for owners who have an attorney and a medical director on paper and are not sure the practice runs the way those documents say it does. Med spa regulations vary by state and change often. Where practices fall short, the gap is usually in the system that carries a rule out: who reviews the charts, who tracks the renewals, who notices when a protocol is a year old. Luminary Strategic is a firm of medical spa consultants whose principals own and operate regulated aesthetics and wellness practices. Luminary advises on those systems in person across Dallas-Fort Worth and virtually nationwide.

WHO HANDLES WHAT IN MED SPA COMPLIANCE

Operational compliance is the set of systems a practice uses to carry out what its attorney and medical director have determined the rules require: who reviews which charts and when, how protocols are kept current, how credentials are tracked, and what the practice can produce when a regulator or buyer asks.

Each question below has an owner. Luminary handles the operating side of the answer, starting from what counsel and the medical director have decided.

When a question belongs to counsel, Luminary says so in writing and frames it for your attorney. The conversation with counsel then starts from specifics.

WHERE COMPLIANCE BREAKS IN A GROWING PRACTICE

Compliance problems in an established practice usually start as operating problems. These are the five patterns an owner-operator sees most often.

Each of these is an operating problem with a legal consequence. Fixing it takes both an attorney and an operator.

WHAT LUMINARY DOES

Compliance is part of each of Luminary's four engagements, so there is no separate compliance product to buy.

PRE-OPENING ADVISORY

For owners opening a practice in Texas, the Pre-Opening Plan includes a compliance build-out sequence: which approvals, agreements, certifications, and protocols must exist before opening day, in what order, and who owns each. Your attorney confirms the med spa requirements in Texas for your concept. The plan puts them on the calendar and in the budget. Pre-Opening Advisory

PRACTICE DIAGNOSTIC

Compliance operations is one of the Diagnostic's four lenses. Luminary checks whether the records a practice should keep exist and are current: supervision and chart review logs, signed delegation protocols, credential and certification tracking, the consent workflow, and business associate agreements with vendors. Many owners think of this as the med spa compliance binder. Findings come back as risk flags, each written as a question for your attorney. Practice Diagnostic

ADVISORY ENGAGEMENT

Compliance Operations and Risk is one of the Advisory Engagement's four focus areas. It covers the design of the practice's compliance systems (which controls must exist and how they connect, without Luminary writing the manuals), delegation and supervision models, medical director governance and economics, readiness for a new service line, oversight across locations, and preparation for a buyer's diligence. Med spa medical director requirements come from the rules and your attorney. The engagement designs what the practice does each week to meet them. Advisory Engagement

EXECUTIVE ADVISORY RETAINER

Every quarterly review includes a compliance calendar: renewals coming due, the medical director's review cadence, open items with counsel, and rule changes to raise with your attorney. Executive Advisory Retainer

WHAT LUMINARY DOES NOT DO

Luminary takes no referral fees from attorneys, compliance vendors, or placement services. A recommendation to use one carries no commission. How Luminary stays independent

MED SPA COMPLIANCE IN TEXAS: WHAT TO ASK YOUR ATTORNEY

Medical spa compliance in Texas changed in 2025, when reorganized Texas Medical Board rules and a new IV therapy law took effect. The summaries below describe four areas in general terms, as of October 2026. Whether and how each one applies to your practice is a question for your attorney.

1. Physician delegation and supervision. The Texas Medical Board's reorganized rules took effect January 9, 2025. Delegation and supervision now sit in 22 Texas Administrative Code Chapter 169. Standing orders and protocols must be in writing and signed by the delegating physician. They must describe the procedures and the level of supervision, include an emergency plan, and be reviewed and signed by the physician each year. Question for your attorney: are our protocols written to Chapter 169, and when was each one last reviewed and signed?

2. Elective IV therapy. HB 3749, known as Jenifer's Law, took effect September 1, 2025, and added Chapter 172 to the Texas Occupations Code. It covers elective IV therapy given outside a physician's office or a licensed health facility. A physician may delegate prescribing to a physician assistant or an advanced practice registered nurse, and administration to a physician assistant, an advanced practice registered nurse, or a registered nurse, each under adequate physician supervision. Prescriptive authority agreements for IV therapy also count toward the physician's existing limit on those agreements. Question for your attorney: does our IV delegation structure meet Chapter 172, and how does it affect our physician's prescriptive authority agreements?

3. Laser hair removal. Texas licenses laser hair removal facilities and certifies the professionals who perform the procedure, under Health and Safety Code Chapter 401, Subchapter M, with program rules at 16 Texas Administrative Code Chapter 118. Each licensed facility retains a consulting physician who sets its protocols. Physicians, and people acting under a physician's delegation, are exempt from that subchapter. Which framework covers a practice's laser work depends on how the service is set up. Question for your attorney: which framework covers our laser hair removal, and are the facility license and individual certifications current?

4. Ownership and management companies. Texas law bars practicing medicine without a license (Occupations Code section 155.001) and bars physicians from aiding unlicensed practice (section 164.052(a)(17)). Those rules are why many practices with non-physician owners pair a physician-owned practice entity with a management services organization. Structure is a legal question. Question for your attorney: is our ownership and management structure sound, and do the fees between our entities match it?

Rules differ by state. For a practice outside Texas, your attorney completes Luminary's State Practice Rules Summary before work begins. For more on Texas: Texas med spa regulations, what to pay a med spa medical director, how to open a med spa in Texas, and Pre-Opening Advisory.

THE COMPLIANCE READINESS QUESTIONS

Luminary's two-page readiness questions are a free starting point for an hour with your attorney. The first half lists what a practice should be able to produce. The second half lists what to ask counsel. A sample of each:

What you should be able to produce:

  • Current delegation protocols and standing orders for each delegated service, each with its last signed annual review

  • A log of chart review and supervision for the last 90 days: who reviewed which charts, and when

  • A list of every license, certification, and permit, with its renewal date and the person responsible

What to ask your attorney:

  • Does our ownership and management structure fit the services we offer?

  • Do our IV therapy and laser services fit the Texas rules that cover them?

  • What has to change before we add a service or a location?
